Kinsarmar laws "The Canon"

Greetings to all,
We, the Ministers, Ereges and Citizens of Kinsarmar "The city of 5
towers" do hereby publicly decree our city laws and ordinances.
We proclaim our set penalties for infractions and crimes against our
Constitution as stated below.

# THE CANON OF KINSARMAR #
##################################

The city of Kinsarmar views the safety of its citizens and guests alike
with the utmost importance. All things within its powers can and will be
used to uphold the laws stated in its constitution, in such a way that
its citizens and guests can remain within its walls without fear from
attacks, harassment and other illegal behaviors or actions against them.
Further, in order for the city to run effectively and harmoniously
certain policies are required. The details can be found in this
document.

Article I: Definitions and Legal Terminologies

A- Citizen:
Any person who carries the citizenship of Kinsarmar. This right can be
revoked if a violent crime is committed, as a result of the committed
offence.
As a citizen, one must contribute to its peace and live by the "The
Kinsarmarian Oath of Citizenship" written on the Crystal Obelisk of
Kinsarmar located at the Crossroad. The city's ruling council can not
enforce city laws upon outsiders not within the city's walls, but the
ruling council can and will enforce city laws on citizens interacting
with other citizens, no matter where the issue occurs.

B- Guest:
Any non-citizen, who has not broken a city law or has not been informed
to the contrary by the ruling council, whose physical location is within
the boundaries of Kinsarmar, as determined by the scope of the Sidhe
Skywatchers.
The security of the Laws of Kinsarmar that is extended to these
individuals is the same as its citizens.
Note: If a citizen has cause to revoke the privileges of a guest please
contact the Minister of Security, or if he/she is not present one of the
city leaders.

C- Pets and familiars:
Any creature loyal and under the control of an individual, being either
a summoned or an eternal companion.
A pet is the responsibility of the individual it is loyal to. This
includes the fact of aggressive acts being performed against a pet are
considered aggressive acts against the owner. Aggressive acts performed
by a pet are considered hostile acts and as if they are acts performed
by the owner. And it will be treated as such.

D- Entities:
Demons of any kind are not allowed within the walls of the city unless a
permit is granted. Citizens may apply for this permit to keep demons in
the city as a defense mechanism by requesting it of the Minister of
Security. This permit carries no fee and will last until such time as
the permit holder proves himself to abuse the privilege.
Non-citizens may not receive a permit for demons. In times of war, the
Duke/Duchess may choose to revoke permits or grant full effects of a
permit for individuals during the duration of the conflict. Any person
bringing said creatures inside city walls without a permit can and will
be charged.

E- Defense:
Any citizen or Guest has the right to defend themselves, when and if
attacked within the walls. They may also call on other citizens or
guests to help defend them at the time of the incident. It is strongly
suggested that you first try to come to a peaceful solution or take it
outside the walls of the city.
However, if the attacker leaves no choice in the matter and persists in
attacking, you may defend yourself freely without repercussion. Once you
are safe bring the matter to the Minister of Security or an Erege, so
the offending individual may be punished accordingly by the laws set
forth in this Canon.

F- Sanctuary:
Citizens of Kinsarmar may seek sanctuary within the walls of Kinsarmar
at any time. Any guest may also seek sanctuary within the wall of
Kinsarmar, provided that they are not running from attacks that have
already been initiated.
If a fight is started and one of the participants attempts to run and
hide within Kinsarmar, they will be asked to leave. Refusal to leave the
city will be viewed as a violation of this law and will be punished
accordingly by an Erege or the Ministry of Security. This can include up
to an enemy status for two years.

G- Respect:
Citizens will not resort to name calling or pointless insulting of
anyone, being either friend or foe. Such are the ways of petty men. When
problems amongst citizens within the city arise, rather than beginning
to bicker about it via the city channel, show them the respect of
granting them a private approach or at least a tactful disagreement on
the city board.
Friendly debating is welcome on the city channel, bearing in mind that
the topics should pertain to the city as a whole. It is inevitable that
disagreements, even arguments, will arise between citizens.
Nevertheless, it is unacceptable that any bear arms against another
fellow citizen. Instead, personal irresolvable grievances should be
brought to the attention of the Ereges.

H- Non Lethal Attack or Assault:
Any aggressive action taken against a citizen, guest or refugee, whose
physical location is within the boundaries of Kinsarmar, with the intent
to harm, threaten, demoralize, kill or injure another, when that action
does not result in death of the victim. This may also be any threat or
attempt upon the physical, mental, or emotional well being of any
citizen or guest.

I- Lethal Attack, Murder:
Any aggressive action taken against a citizen, guest or refugee, whose
physical location is within the boundaries of Kinsarmar, with the intent
to harm, threaten, demoralize, kill or injure another, or when the
action does result in the death of the victim. Being accidental or not.
This does not apply in case of Self-defense after being attacked or
assaulted.

J- Harassment:
Any threat or attempt to harm the well being of any citizen or guest
that is not already covered under assault.
This is the act of detaining a citizen, speaking or acting out in their
name without stated permission, denying them their personal belief, spam
tells or messages, crude conduct, unwanted following, or other actions
determined at the discretion of the Minister of Security.
NOTE: Sexual Harassment, will be seen as a 2nd offence by the City Laws,
and will also be issued.

K- Theft:
Any act of attempting to remove, taking or transporting any item,
physical property, gold, or credits from a citizen, guest, business,
shop, stockroom, residence, guildhall, or the city of Kinsarmar itself
without the explicit permission of said individuals.
Destruction of property, no matter the form, will be treated and seen as
theft.
NOTE: If an item or article can be returned safely to the owner/owners,
the fine will be set at 50 percent of the estimated value of the stolen
item or article. In case the stolen item or article can not be returned,
the fine will be set at 200 percent of the total estimated value of the
stolen or damaged item or article.

L- Trespassing:
Committing an unlawful injury to the person, property, or right of
another, with actual or implied force or violence, especially to enter
another's land wrongfully is defined as trespassing. All guildhalls
within Kinsarmar and the guild members who reside therein are under the
protection of the Kinsarmar laws.
NOTE: Only with permission granted by a guildmaster can an individual
(Non guild member) gain access to enter a guildhall.

M- Treason:
Any act in which material, immaterial, informational aid or comfort is
provided to the enemy, in which the perpetrator intentionally
compromises his / her allegiance to the city and which undermines or
goes against the authority of the ruling council of Kinsarmar or its
designated ministers. A joke that is retold elsewhere is not considered
treason. Passing on information related to the defenses or political
goals of the city, however, is.
NOTE: Disloyal thoughts or attempts to replace officers within the
government, "Mutiny", are not treason.

N- Conspiracy:
Any agreements between two or more persons to commit a crime, accomplish
legal purpose through illegal action, or wrongfully incriminate another
person in a crime. The penalty for violation of this law is applicable
to all individuals involved in the conspiracy, regardless of passive or
active participation in the crime committed.

O- Shrines:
Every shrine within Kinsarmar, which is not within a guildhall, must be
approved for by the ruling council. The shrines located within any of
the guildhalls must be approved for by the Guildmaster of that guild.
Shrines for any Deity that is enemied by the city may not be erected or
maintained within the guildhalls.
Defiling any approved shrine or sanctifying any unapproved shrine within
Kinsarmar is forbidden, thus illegal. For a list of approved shrines
please read "Chelp Shrines".

P- Sewers:
Kinsarmar does not allow enemies to reside within the city's sewer
system. Any enemy that chooses to occupy the underground does so at
his/her own risk. The ruling council gives leave to the city protectors
to pursue all enemies disobeying this fundamental law.

Scope: These laws are in effect anywhere within the range of the
Kinsarmarian Sidhe Skywatchers. Shops and private domains that are a
part of Kinsarmar are not excluded from these laws.
CDF: City disfavor
gp: gold sovereigns

Enemies of the city-state of Kinsarmar and those persons not in
accordance with its laws will not be protected under these laws.


Article II: Offences

A- First Offence:
All penalties and fines stated in Article III are applicable for a first
time offense.

B- Second Offense (If not stated different in Article III):
Penalties, fines and terms of enemy status are to be increased by one
half (multiplied by 1.5).
Example: a 5.000 gp fine and 2 years enemy status would become a 7.500
gp fine and 3 years enemy status.

C- Third Offense (If not stated differently in Article III):
For a third similar offence or infraction, penalties, fines and terms of
enemy status are tripled (multiplied by 3).
Example, a 5.000 gp fine would become a 15.000 gp fine. Depending on the
nature of the infraction, the ruling council and security minister have
the right to either triple the enemy sentence or brand the offender an
enemy for all time. The reason for this is because there is or can be no
excuse for a third offense.

D- Simultaneous Offenses:
In the case that a crime is committed multiple times before a warning by
any citizen has been given, or is addressed or dealt with by the council
or Minister of Security, the crime is then counted as a first offense.
After a warning has been issued, each offense counts individually
against the perpetrator. Punishment for any offense after the third is
at the discretion of the security minister or ruling council, but will
not be less than the third offense penalty (resulting most of the time
in a permanent enemy status).

E- Refusal to pay fines and accept penalties:
In case an offence or penalty is fined and is coupled with an enemy
status, the enemy status will begin from the moment the fine is paid.
Therefore with a 5.000 gp fine and an enemy status of 1 year, if the
fine is not paid, the time allotted for the enemy sentence will not
begin winding down and the criminal will remain an enemy until the
amount of 5.000 gp is paid in full.

F- In case an offence or penalty is fined and is NOT coupled with an
enemy status, the fine must be paid within one year.
If the fine is not paid by the set date, the criminal will be given an
enemy status for one year and the time allotted for the enemy status
will not begin winding down until the amount is paid in full. At this
time the Minister of Security or ruling council may opt to open a bounty
on the offender until the fine is paid.


Article III: Offence and Fines

A- Pets and familiars:
Anyone caught attacking or killing doves within the city will be given a
warning on the first offence and then be fined 1.000 gp for each offence
thereafter.
In the case that multiple offences occur and no previous fines are paid,
an individual may be given enemy status at the advisement of the Council
or the Minister of Security. This Canon also applies to all non-sentient
beings loyal to the city of Kinsarmar.

B- Entities:
The fine is set at 1.000 gp payable to the city.

C- Non Lethal Attack or Assault:
The fine is set at 5.000 gp payable to the city and 3.000 gp payable to
the victim and is coupled with an enemy status of 3 years.
NOTE: In case the assailant is a citizen, the fine will be raised to
10.000 gp payable to the city and 6.000 gp payable to the victim. The
assailant will also be granted a "CDF" on the first offense. Any further
offenses will result in the removal of citizenship, enemy status for six
years, and including the fines stated above.

D- Lethal Attack, Murder:
The fine is set at 10.000 gp payable to the city and 5.000 gp, plus
2.500 gp per level lost payable to the victim and is coupled with an
enemy status of 5 years.
NOTE: In case the assailant is a citizen, the fine will be raised to
20.000 gp payable to the city and 10.000 gp payable to the victim. The
assailant in this case will lose citizenship and be granted enemy status
for no less than 10 years.

E- Harassment:
Report of harassment should be messaged to the Minister of Security. The
fine is set at 2.000 gp payable to the city.
In case the assailant is a Non-citizen, as well as fines, an enemy
status for a period of 6 months will be added in any further offenses.
NOTE: In case the assailant is a citizen and depending on the nature of
the infraction, assault can result in a "CDF" or the revocation of
citizen status.

F- Theft:
The fine is set at 5.000 gp payable to the city as well as repayment to
the victim for the items stolen. In the case that an artifact is stolen,
or any item which will end up back with the victim as a result of Divine
intervention, the thief will be charged 5.000 gp to the city as well as
10 gp for each credit of the artifact's value. The fine will be coupled
with an enemy status of 2 years.
NOTE: In the case the assailant is a Citizen, a "CDF" will be coupled to
the fines on the 1st offence, but at the 2nd offence this will result in
the revocation of citizen status.

G- Trespassing:
The fine is set at 1.000 gp. If the assailant does not leave the
premise, the fine may be raised repeatedly until it equals 5.000gp.
After that time, the assailant can be made an enemy to the city for the
period of one year.

H- Treason:
In the case the assailant is a Non-citizen, the fine is set at 20.000 gp
and will be coupled with an enemy status of 5 years.
In the case the assailant is a Citizen, the punishment for treason will
be decided by the ruling council and fines placed to a maximum of 30.000
gp. The punishment will include revocation of position, be it citizen,
minister, or council member and may include banishment, confiscation of
any shops owned within the city, enemy status, or the seizure of any or
all city properties held by the individual.

I- Conspiracy:
In case the assailant is a Non-citizen, the fine is set at up to 10.000
gp and an enemy status of 2 years.
In case the assailant is a citizen, the fine is set at up to 15.000 gp,
plus banishment from the city for the period of 1 year.

J- Shrines:
Defiling any approved shrine or sanctifying any unapproved shrine within
Kinsarmar will be fined 10.000 gp per shrine and will be coupled with an
enemy status of 5 years.


Article IV: Commercial Laws

A- Taxes:
A citizen tax will never be set unreasonably, but in times of need a tax
may be levied to help the city.
Any shopkeeper who has not paid their shop taxes within 2 years shall
find their shop closed and the stockroom sealed by the Kinsarmarian
Council. The shopkeeper will then have six months to pay all the unpaid
taxes and a 3.000 gp late fee to Kinsarmar, or the shop will be
repossessed by the city along with all remaining stock.

B- Repossession:
A city shop may be repossessed for one or a combination of the following
three offenses:
1. Failure to pay taxes for more than 2 consecutive years.
2. A city shop being closed due to owner's inactivity.
3. A shopkeeper under enemy status for more than 3 years or for a
repeated criminal offense.
NOTE: If repossession occurs, the merchandise and profits within the
stockroom fall under the jurisdiction of the Chancellor's ministry. On
behalf of the city, that ministry may do what it deems with the
repossessed goods and monies. In the case of guild-restricted items,
said items will be returned to the master of that guild.

C- Miscellaneous:
The city of Kinsarmar reserves the right to change any shop descriptions
or titles if they are found unfit in any way. This is at the discretion
of the Chancellor. Shops are to be used for revenue purposes only.
Pricing a large number of items at excessive prices will result in an
increased tax on the shop. Please note that there are exceptions to this
policy and it is at the choice of the Council. Monolith sigils and other
things used for protection are an exception to this rule. All
shopkeepers in Kinsarmar are bound to these laws. With the purchase of a
shop the new owner has agreed to abide by these laws, whether a spoken
or written agreement took place or not.

D- Private Sales:
There are no city-restrictions placed on private sales. If a shop is
sold to a new owner, the new owner will assume responsibility for the
shop including all outstanding debts.

E- Shop-keeping:
A city shop will remain open when an owner is an enemy unless the enemy
status was accrued in a repeated offense or will persist for two years
or more. If the taxes exceed permissible limits while the owner is an
enemy, the shop will then be closed by the city and sold thereafter.

F- Stock:
It is the responsibility of the shopkeeper to ensure that his or her
shop is being used to sell wares. If there are no wares for sale, the
Chancellor's ministry will issue a warning to the shopkeeper. If the
status of the shop's wares does not change within three months of the
warning, the city will claim the shop.
NOTE: The city is not responsible for ensuring that merchants follow the
guild pricing guidelines. An exception to this are the minimum prices
already set on herb and vial sales that have been previously approved by
the Council and the minimum prices set by the City Guilds, for example
the "Runetreaty" and the "Enchantmentlist". Pricing infractions on the
part of any shopkeeper should be taken up between the guild and the
merchant. On other matters of prices, the city will not get involved
except in a case of shop repossession as addressed above.
